Retailers file suit over Austin’s looming bag ban
Austin’s plastic bag ban is set to take effect Friday, but a group of retailers has filed suit against the city, seeking an injunction to stop the ban from becoming a reality.
The Texas Retailers Association said the ban violates part of the state’s health and safety code.
According to the lawsuit, Texas Health and Safety Code states "A local government or other political subdivision may not adopt an ordinance, rule or regulation to prohibit or restrict, for solids waste management purposes, the sale or use of a container or package in a manner not authorized by state law.”
Starting Friday, Austin retailers are banned from offering thin, single-use paper and plastic bags at checkout, but there are some exceptions.
